Attendee Media and Liability Release

This Attendee Media and Liability Release (this "Release") applies to each person who attends, participates in, enters, or is present at the LMNOP3 event described below (the "Event"). By attending the Event, each attendee, and each parent or legal guardian on behalf of any minor attendee, agrees to the terms of this Release.

Article 2:            Acknowledgment of Event Activities and Conditions

The Event is an all-ages, family-friendly community fundraiser that may include music, DJs, food service by third-party vendors, face painting, bubble machines, sprinklers, bounce houses, and other recreational or community activities. The attendee understands that the Event may involve crowds, uneven ground or outdoor conditions, weather-related conditions, amplified sound, water play, inflatable play equipment, and ordinary risks associated with being present at a public or private community event.

Each attendee acknowledges that participation in any activity at the Event is voluntary. Each attendee, and each parent or legal guardian for a minor attendee, accepts responsibility for determining whether attendance and participation are appropriate for the attendee’s health, comfort, maturity, and abilities.

Article 3:            Consent to Photography, Video, Audio, and Drone Capture

The attendee understands and agrees that LMNOP3 and its representatives, contractors, volunteers, media partners, sponsors, photographers, videographers, and drone operators may photograph, film, record, livestream, or otherwise capture the attendee’s name, image, likeness, voice, statements, appearance, and activities at the Event by any means or media now known or later developed, including still photography, video, audio recording, drone photography, drone video, and other aerial or ground-based capture methods (collectively, "Recordings").

By attending the Event, the attendee, and each parent or legal guardian for a minor attendee, gives LMNOP3 permission to create and use the Recordings for lawful nonprofit, educational, informational, archival, promotional, fundraising, marketing, public relations, editorial, documentary, and social media purposes, without further approval, notice, inspection rights, or compensation.

This permission includes the right to edit, crop, adapt, modify, combine with other materials, publish, display, distribute, transmit, reproduce, sublicense, and otherwise use the Recordings, in whole or in part, in any format or media, including websites, email communications, digital advertising, printed materials, annual reports, grant materials, sponsorship materials, press materials, social media platforms, and internal records.

Article 4:            Release of Publicity, Privacy, and Related Claims

To the fullest extent permitted by law, the attendee, and each parent or legal guardian for a minor attendee, releases and discharges LMNOP3 and its directors, officers, employees, volunteers, contractors, agents, representatives, sponsors, successors, assigns, venue partners, event partners, photographers, videographers, drone operators, and media partners (collectively, the "Released Parties") from any and all claims, demands, liabilities, damages, actions, or causes of action arising out of or related to the creation or use of any Recording, including claims for invasion of privacy, intrusion, misappropriation of likeness, appropriation of name or image, right of publicity, defamation, false light, emotional distress, or copyright or similar claims relating to the attendee’s participation in the Recordings, except to the extent caused by a Released Party’s gross negligence or willful misconduct or where such release is prohibited by applicable law.

Article 5:            Social Media Use

The attendee understands and agrees that Event-related Recordings and materials may be posted or reposted on websites and social media channels operated by LMNOP3 or third parties, and may be shared, commented on, copied, embedded, or further distributed by platform users or the public. LMNOP3 cannot control third-party reposting, downloads, screenshots, comments, or downstream uses once content is publicly shared.

Article 6:            Takedown Requests for Particular Photos or Videos

LMNOP3 will consider good-faith requests to remove or stop further use of particular photos or videos depicting a specific attendee. A request must be submitted to the contact listed above and should include sufficient detail to identify the image or video at issue, the approximate date and time it was captured or posted, the platform or publication where it appears, and information reasonably sufficient to identify the requester and the basis for the request.

LMNOP3 does not guarantee removal in every case, but will review each request in good faith and may, in its discretion, remove content from channels under its reasonable control or stop future use of identified content. LMNOP3 is not responsible for removing content posted, reposted, archived, downloaded, screen-captured, or otherwise distributed by third parties not under its control.

Article 7:            Assumption of Risk

TO THE FULLEST EXTENT PERMITTED BY MONTANA LAW, EACH ATTENDEE, AND EACH PARENT OR LEGAL GUARDIAN ON BEHALF OF A MINOR ATTENDEE, KNOWINGLY AND VOLUNTARILY ASSUMES ALL RISKS OF ATTENDING OR PARTICIPATING IN THE EVENT, WHETHER KNOWN OR UNKNOWN, OBVIOUS OR NOT OBVIOUS, FORESEEABLE OR NOT FORESEEABLE, INCLUDING RISKS OF PERSONAL INJURY, ILLNESS, ALLERGIC REACTION, PROPERTY DAMAGE, PROPERTY LOSS, WATER-RELATED SLIPS OR FALLS, CONTACT WITH OTHER ATTENDEES, EQUIPMENT-RELATED INCIDENTS, BOUNCE HOUSE OR PLAY ACTIVITY INCIDENTS, FOOD-RELATED ISSUES, WEATHER-RELATED CONDITIONS, AND OTHER ORDINARY RISKS ASSOCIATED WITH EVENT ATTENDANCE AND PARTICIPATION.

Article 8:            Release and Waiver of Liability

TO THE FULLEST EXTENT PERMITTED BY MONTANA LAW, EACH ATTENDEE, AND EACH PARENT OR LEGAL GUARDIAN ON BEHALF OF A MINOR ATTENDEE, FOR THEMSELVES AND FOR THEIR HEIRS, ESTATE, PERSONAL REPRESENTATIVES, INSURERS, SUCCESSORS, AND ASSIGNS, RELEASES, WAIVES, AND DISCHARGES THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, LOSSES, DAMAGES, LIABILITIES, COSTS, AND EXPENSES, INCLUDING CLAIMS FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO THE ATTENDEE’S ATTENDANCE AT, PRESENCE AT, ENTRY TO, OR PARTICIPATION IN THE EVENT, INCLUDING CLAIMS ALLEGED TO RESULT FROM THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY.

THIS RELEASE DOES NOT APPLY TO CLAIMS TO THE EXTENT CAUSED BY A RELEASED PARTY’S GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR OTHER CONDUCT FOR WHICH LIABILITY CANNOT BE WAIVED OR RELEASED UNDER APPLICABLE LAW.

Article 9:            Covenant Not to Sue

To the fullest extent permitted by law, each attendee, and each parent or legal guardian on behalf of a minor attendee, agrees not to sue or bring any claim against any Released Party for any matter released under this Release. If any such claim is brought in violation of this provision, the claimant will be responsible for the Released Parties’ reasonable costs and attorneys’ fees incurred in defending against that claim to the extent permitted by applicable law and awarded by a court of competent jurisdiction.

Article 10:         Medical and Supervisory Responsibility

LMNOP3 is not providing medical care, mental health treatment, childcare, or supervision services at the Event. Parents and legal guardians are solely responsible for supervising minors in their care at all times. Each attendee is responsible for managing their own medical, dietary, mobility, sensory, and personal needs while attending the Event.

In the event of an emergency, the attendee authorizes Event personnel to contact emergency responders. The attendee remains responsible for any medical or emergency service costs incurred on the attendee’s behalf or on behalf of any minor attendee for whom the attendee is responsible.

Article 11: Third-Party Vendors and Activities

The Event may include food trucks, performers, equipment providers, or other third-party vendors or service providers. LMNOP3 does not manufacture food, operate every activity, or control every third-party act or omission at the Event. To the fullest extent permitted by law, the attendee accepts the risks associated with engaging with third-party vendors and activities and understands that additional vendor-specific rules or waivers may apply.

Article 12:         Minors

A parent or legal guardian who permits a minor to attend the Event represents that they have authority to agree to this Release on the minor’s behalf to the fullest extent permitted by applicable law. The parent or legal guardian consents to the minor’s participation in Event activities and to the photography, video, audio, and drone capture and use described in this Release. To the extent Montana law limits a parent’s or guardian’s ability to waive or release claims on behalf of a minor, this Release will be interpreted to provide the broadest enforceable assumption of risk, consent, indemnity, and other protections permitted by law.

Article 13:         Indemnity

To the fullest extent permitted by law, each attendee, and each parent or legal guardian on behalf of a minor attendee, agrees to indemnify, defend, and hold harmless the Released Parties from and against any third-party claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to (a) the attendee’s acts or omissions at the Event, (b) the attendee’s breach of this Release, or (c) the attendee’s supervision of, or failure to supervise, any minor attending with the attendee.

Article 14:         No Reliance; No Medical or Therapeutic Services

The attendee acknowledges that the Event is a community fundraiser and informational gathering only. No medical treatment, psychotherapy, clinical services, or administration of controlled substances will be provided by LMNOP3 as part of the Event, and no attendee is relying on the Event as a substitute for professional medical, psychological, or legal advice.

Article 15:         Severability and Interpretation

If any provision of this Release is held invalid or unenforceable, the remaining provisions will remain in full force to the fullest extent permitted by law. This Release will be interpreted broadly to maximize its enforceability, but not beyond what applicable law allows.

Article 16:         Governing Law and Venue

This Release is governed by the laws of the State of Montana, without regard to conflict of laws principles. Any dispute arising out of or relating to this Release or the Event must be brought exclusively in the state or federal courts located in Montana, and each attendee consents to the personal jurisdiction and venue of those courts.

Article 17:         Acceptance

BY ATTENDING THE EVENT, THE ATTENDEE CONFIRMS THAT THE ATTENDEE HAS READ THIS RELEASE, UNDERSTANDS IT, AND AGREES TO BE BOUND BY IT. IF THE ATTENDEE IS A PARENT OR LEGAL GUARDIAN OF A MINOR ATTENDEE, THE PARENT OR LEGAL GUARDIAN CONFIRMS THAT THEY HAVE READ THIS RELEASE, UNDERSTAND IT, AND AGREE TO IT ON THEIR OWN BEHALF AND, TO THE FULLEST EXTENT PERMITTED BY LAW, ON BEHALF OF THE MINOR ATTENDEE.

Parent/Guardian Waiver for Minor Attendees

This Parent/Guardian Waiver for Minor Attendees (this "Minor Waiver") is intended to be signed by the parent or legal guardian of each person under 18 years of age attending the Event (a party hosted by LMNOP3 on August 2, 2026, at The Patio in Whitefish, Montana).

Article 2:            Consent to Attendance and Participation

I represent that I am the parent or legal guardian of the minor identified above and have legal authority to sign this Minor Waiver. I give permission for the minor to attend the Event and to participate in age-appropriate activities made available at the Event, including recreational and family-oriented activities.

I understand that I am solely responsible for supervising the minor at all times unless LMNOP3 expressly agrees otherwise in writing, and I acknowledge that LMNOP3 is not providing childcare or supervision services.

Article 3:            Consent to Photography, Video, Audio, and Drone Capture of Minor

I consent to LMNOP3 and its representatives, contractors, volunteers, media partners, sponsors, photographers, videographers, and drone operators photographing, filming, recording, livestreaming, or otherwise capturing the minor’s name, image, likeness, voice, appearance, and activities at the Event by any means or media now known or later developed, including still photography, video, audio recording, drone photography, and drone video.

I grant LMNOP3 permission to create and use those recordings for lawful nonprofit, educational, informational, archival, promotional, fundraising, marketing, public relations, editorial, documentary, and social media purposes, without further approval, notice, or compensation, subject to LMNOP3’s takedown request process for particular photos or videos.

Article 4:            Assumption of Risk for Minor

TO THE FULLEST EXTENT PERMITTED BY MONTANA LAW, I KNOWINGLY AND VOLUNTARILY ASSUME, ON MY OWN BEHALF AND TO THE EXTENT PERMITTED BY LAW ON BEHALF OF THE MINOR, ALL RISKS ARISING OUT OF OR RELATING TO THE MINOR’S ATTENDANCE AT OR PARTICIPATION IN THE EVENT, INCLUDING RISKS OF PERSONAL INJURY, ILLNESS, ALLERGIC REACTION, PROPERTY DAMAGE, PROPERTY LOSS, WATER-RELATED SLIPS OR FALLS, CONTACT WITH OTHER ATTENDEES, EQUIPMENT-RELATED INCIDENTS, BOUNCE HOUSE OR PLAY ACTIVITY INCIDENTS, FOOD-RELATED ISSUES, WEATHER-RELATED CONDITIONS, AND OTHER ORDINARY RISKS ASSOCIATED WITH EVENT ATTENDANCE AND PARTICIPATION.

THIS MINOR WAIVER DOES NOT APPLY TO CLAIMS TO THE EXTENT CAUSED BY A RELEASED PARTY’S GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR OTHER CONDUCT FOR WHICH LIABILITY CANNOT BE WAIVED OR RELEASED UNDER APPLICABLE LAW.

TO THE EXTENT MONTANA LAW LIMITS A PARENT’S OR GUARDIAN’S ABILITY TO WAIVE OR RELEASE CLAIMS ON BEHALF OF A MINOR, THIS MINOR WAIVER WILL BE INTERPRETED TO PROVIDE THE BROADEST ENFORCEABLE ASSUMPTION OF RISK, CONSENT, INDEMNITY, AND OTHER PROTECTIONS PERMITTED BY LAW.

Article 6:            Medical Authorization and Emergency Contact

If emergency medical care is reasonably necessary for the minor during the Event and I cannot be reached promptly, I authorize LMNOP3 to contact emergency responders. I understand that LMNOP3 is not obligated to provide medical care and that I remain responsible for all medical and related expenses incurred on behalf of the minor.

Article 7:            Indemnity

To the fullest extent permitted by law, I agree to indemnify, defend, and hold harmless the Released Parties from and against any third-party claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to (a) the minor’s acts or omissions at the Event, (b) my breach of this Minor Waiver, or (c) my supervision of, or failure to supervise, the minor.

Article 8:            Governing Law and Venue

This Minor Waiver is governed by the laws of the State of Montana, without regard to conflict of laws principles. Any dispute arising out of or relating to this Minor Waiver or the Event must be brought exclusively in the state or federal courts located in Montana, and I consent to the personal jurisdiction and venue of those courts.

Assumption of Risk

BY ENTERING, YOU VOLUNTARILY ASSUME THE ORDINARY RISKS OF ATTENDING THIS EVENT, INCLUDING RISKS ASSOCIATED WITH CROWDS, OUTDOOR CONDITIONS, MUSIC, WATER FEATURES, BOUNCE HOUSES, FOOD SERVICE, AND OTHER EVENT ACTIVITIES.

TO THE FULLEST EXTENT PERMITTED BY MONTANA LAW, YOU RELEASE LMNOP3 AND RELATED EVENT PARTIES FROM CLAIMS ARISING OUT OF YOUR ATTENDANCE OR PARTICIPATION, EXCEPT TO THE EXTENT CAUSED BY GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR OTHER NON-WAIVABLE CONDUCT.

PARENTS AND LEGAL GUARDIANS ARE RESPONSIBLE FOR SUPERVISING MINORS AT ALL TIMES.
